- 12/1/06 - Marks & Harrison sponsors the Brain Injury
Association of Virginia's 2006 Charity Golf Classic.
- 12/1/06 - The American Association of Trial Lawyers
has selected two of the Firm's associates to serve on
the New Lawyers Division Board of Governors. Eric D.
Yost of Charlottesville and James M. Kessel of Richmond
have each been selected to serve one year terms on the
Board of Governors, where they will work to promote
justice while addressing the needs of young attorneys in
Virginia and across the nation. They were the only two
in Virginia to be named to the Board.
- 1/7/06 - Roger T.
Creager and Bridget N. Long filed a brief in the
Virginia Supreme Court which argues that injured tenants
should be able to rely upon the Virginia Residential
Landlord and Tenant Act as a basis for bringing a
lawsuit to recover damages for personal injuries caused
by dangerous conditions on the leased premises. The case
is Isbell v. Commercial Investment Associates, Inc.
(Virginia Supreme Court Record No. 061000). A copy of

- 10/25/06 - The
Virginia Supreme Court refused to grant a writ of appeal
to defense lawyers representing a doctor against whom a
Page County jury awarded damages of nearly $1 million
for negligent shoulder replacement surgery. Creager was
co-author of the successful brief on appeal which argued
that the jury's verdict should not be disturbed. The
case is Kemp v. Jenkins (Virginia Supreme Court Record
Number 061541).

John C. Shea moderated a panel for the VTLA on marketing
"How to improve your results for the small and solo
lawyer."
- 10/13/06 & 10/14/06
- Roger T. Creager presented two subcommittee study
reports to the annual 2006 Boyd-Graves Conference held
in Virginia Beach. The Conference was attended by more
than 100 outstanding trial lawyers, judges, and
legislators from across Virginia. Creager was the only
Conference member who served as the Chair of two
Boyd-Graves Conference study committees this year.

At the invitation of the Virginia Trial Lawyers
Association, Roger T. Creager gave seminar
presentations in Richmond and Roanoke on October 5
and 10, 2006, respectively, on "Filing Suit,
Discovery, and Pretrial Preparation."
- 10/2/06 - Roger T.
Creager filed a Brief Amicus Curiae on behalf of the
Virginia Trial Lawyers Association in support of a
Virginia trial court's award of monetary penalties
against a Ford Motor Company lawyer whom the trial court
found filed defenses for which he lacked a sufficient
good faith basis in fact and law. The case is Ford Motor
Company v. Benitez (Virginia Supreme Court Record No.
051769).
- 10/10/06 - John C. Shea lectured to members of the
VTLA on opening arguments.
- 10/1/06 - James M. Kessel and Eric D. Yost attended
an American Association for Justice (ATLA)
meeting on Thursday, September 28, 2006, in Washington
DC. The meeting consisted of approximately 15 young
lawyers from around the nation who volunteered their
time to raise awareness about the upcoming House of
Representative races. The purpose of the meeting was to
raise awareness among ATLA members in the New Lawyers
Division (NLD) about the upcoming races and the
importance of becoming active in the political struggle
to preserve the civil justice system. By contacting NLD
members, informing these members of the importance of
the races to the civil justice system, and by accepting
pledges to donate to ATLA’s spotlighted campaigns; the
group was able to raise over $20,000 for the campaigns.
- 10/1/06 - James A. McCauley was elected President of
the Board of Directors of the Central Virginia Legal Aid
Society. Prior to this election James served as the Vice
President of the Board of Directors.
- 9/1/06 - John D. Ayers present three new laws
to the legislative committee earlier this month. These
laws will strengthen penalties faced by those driving
under the influence of illegal drugs and allow personal
injury cases to be solved in a timely manner.
- 9/1/06 - Marks & Harrison is please to announce
Gregory S. Hooe has become a member of the American
Board of Trial Advocates.
- 8/31/06 - Roger T. Creager and Bridget N. Long
successfully briefed and argued a Motion for New Trial
in federal court in Danville in the case, Hall v.
Wal-Mart Stores East, L.P. As a result, Marks & Harrison
lawyers, on behalf of Ms. Hall, who was injured when she
slipped and fell in a Wal-Mart store, will be able to
put on all of their evidence at a jury trial against
Wal-Mart in early 2007. A copy of the federal court's

- 8/15/06 - Roger T. Creager published an article in
the Virginia Trial Lawyers Association Journal on the
use of grief experts in wrongful death actions under
Virginia law. The article, entitled, "Grief Expert
Testimony is Admissible When Helpful," is available on
this webpage under the heading, "Press," below.
- 8/1/06 - Ray P. Lupold, III, upon the recommendation
of the Virginia State Bar Professionalism Committee, has
been invited to join the Virginia State Bar
Professionalism Course Faculty. The faculty, consisting
of some of the Commonwealth's best judges and lawyers,
teaches the fundamental values of the profession to
newly-licensed Virginia lawyers.
- 7/1/06 - See our ad in the July edition of Richmond
magazine congratulating James A.
McCauley, Roger T. Creager, and John C. Shea on being
named Super Lawyers for 2006
- 7/1/06 - Roger T. Creager was appointed by the
President of the Virginia State Bar to serve as the
Vice-Chair of the Virginia State Bar's Standing
Committee on Legal Ethics. This is Creager's fifth year
on the Committee, which issues opinions regarding the
ethical standards that govern Virginia attorneys.

6/1/06 - John C. Shea contributed to the
second edition of Truck Accident Litigation by
writing the chapter The Lawyer’s Role. A
copy of this text , which examines the investigation and
litigation of a truck accident case. The book can be purchased

- 5/1/06 - John C. Shea participated in his role as a faculty
member of the Virginia College of Trial Advocacy program
held at the College of William and Mary on May 19 and
May 20, 2006. This program focused on the art of
cross-examination. Todd R. Henningsen, Eric D. Yost,
John D. Ayers, and James Mick Kessel attended the
program as students in the specialized college that
seeks to train the next generation of trial lawyers in
Virginia.
- 4/1/06 - Roger Creager of Marks & Harrison, P.C.,
recently spoke to the Virginia Trial Lawyers
Association's 2006 Annual Convention. Creager addressed
the convention regarding the work of the VTLA's Amicus
Curiae Committee which he chairs. Since 2000, the
positions supported by VTLA Amicus Curiae briefs has
prevailed in 21 of 24 cases pending before Virginia
appellate courts, both state and federal. At the
Convention, Creager awarded VTLA Amicus Curiae Honor
Roll Certificates Honoring the authors of VTLA Amicus
Curiae briefs. Creager was also again selected to serve
on the VTLA Board of Governors.
- 4/1/06 - Gregory Hooe joined Marks & Harrison as an
Associate.

Seminar.
- 1/1/06 - Bridget Long of Marks & Harrison and YTL
Chair-Elect spoke at the Richmond "Breaking the
Cycle" seminar on possible tort remedies for victims
of sexual violence. "Breaking the Cycle" is a
full-day training program for advocates of victims offered
throughout the state by the Virginia Poverty Law Center.
